The present general conditions of sale are concluded between:

ARTICLE 4: PRODUCTS

The items offered for sale by JEAN MARC PHILIPPE are those listed on the Site, the day of its consultation by the client, within the limits of available stocks.

At any time and without notice, JEAN MARC PHILIPPE reserves the right to modify or adapt these general conditions of sale. In this case, the new general conditions of sale automatically apply to any order after the changes. Thus, the applicable conditions are those in effect on www.jeanmarcphilippe.com at the date of placing the order by the client. 


ARTICLE 6: PRICES

The prices of items on the Site are presented in euros all taxes included (TTC) and excluding delivery costs and return shipping costs (see article 11 delivery) which remain the responsibility of the customer.

The prices of the items indicated on the Site take into account the VAT applicable on the day of the order. In the event of a change in the VAT rate, these changes could be reflected in the price of the items without the customer being informed beforehand.

JEAN MARC PHILIPPE reserves the right to change prices at any time, but agrees to apply the current rates indicated to the customer at the time of registration of the order. 

ARTICLE 7: ORDER

Any order implies express and irrevocable acceptance of prices and descriptions of items available for sale.

An order constitutes a purchase order from the client made exclusively through the site, for the purpose of acquiring one or more products offered for sale on this Site. The order is final when the customer has made the acceptance after passing all the necessary steps.

The client must create a customer account in order to place one or more order (s). His account will be accessible via an identification by email address and password.

The order will not be definitively recorded until the last validation of the payment screen of the order by credit card and / or gift card (s) or Paypal. From the last click of acceptance, the order is considered irrevocable.

Following this last step of validation, an electronic message is then sent to the customer to confirm the taking into account of his order by JEAN MARC PHILIPPE.

The customer will be able to consult the summary of her order by questioning her personal account on the JEAN MARC PHILIPPE Website. The client will also be able to follow the delivery of his parcel by going to his account, in "My orders", and by clicking on the tracking number colissimo associated with his order. 

We inform you that there is a variable delay of 24 to 48 hours between the departure of our warehouse and the update of the follow-up of delivery on the site of our carrier.

ARTICLE 8: PAYMENT

Payment is made online by credit card and / or gift card (s) or paypal. 
Gift vouchers are not accepted on the Site. 

8.1 - PAYMENT BY BANK CARD:

Accepted credit cards are: credit card, Visa, Mastercard and Maestro.

The client's bank account will only be charged upon shipment of the package. In case of partial unavailability of certain items of the order, the bank account of the customer will be debited only the products sent. In case of cancellation of the order, the bank account of the client will not be charged.

8.2 - PAYMENT BY PAYPAL:

It is possible to pay your order via Paypal. 
The customer, having beforehand a Paypal account, will have to enter their email address associated with the account and the paypal password. 
In case of cancellation of the order, the Paypal account will automatically be credited. 
In case of incomplete orders, the amount of missing item (s) will be refunded to the Paypal account. 


ARTICLE 9: SECURITY OF PAYMENTS

To ensure payment security, the Site uses Société Générale's secure payment service. This service incorporates the SSL (Secure Socket Layer) security standard. The confidential data (the 16-digit bank card number, the expiry date and the cryptogram) are transmitted directly encrypted on the SIPS server without passing on the physical media of the JEAN MARC PHILIPPE server. JEAN MARC PHILIPPE does not have access to this confidential information.

ARTICLE 10: DELIVERY

10.1- PLACE OF DELIVERY

JEAN MARC PHILIPPE delivers everywhere in Metropolitan France & Corsica. As well as in the following countries: Belgium, Germany, England & Wales, Italy, Luxembourg, Netherlands, Spain, Portugal and Austria. 
When ordering, the customer has the opportunity to enter the delivery address of their choice (home, workplace, holiday location, etc ...). It can modify it until the validation of the order. The name entered in the delivery address will be the same as that of the mailbox. For deliveries other than at home, the name of the company must be well informed before the validation of the order. 
The delivery of the package will be made to the delivery address validated during the order. If the address has been modified after the validation, report it as soon as possible to the customer service JEAN MARC PHILIPPE in the section Contact us, the change will be made if the order is said: "in progress". No modification can be made when the order will be said: "in preparation" or "in delivery", the change of address will be made only on the next order.

10.2- TIME FOR PREPARATION

Any order validated before 15:00 will be processed the next working day. 
The preparation time of 24 hours can be extended exceptionally during the sales period or any other promotional operation. 
In case of delay in preparation, (computer problem, strike, climatic constraints), JEAN MARC PHILIPPE can not be held responsible. The client will be notified by e-mail or mail.

10.3- TERMS OF DELIVERY

The parcel is sent to the address indicated by the customer, during the validation of his order by the services of the post office.

SHIPPING SHOP

The delivery in store is free from € 30 purchase, otherwise the amount of shipping is € 3.

This delivery method is 2 working days.

Orders are delivered to the store chosen by the customer from Monday to Saturday during the opening hours of the store. The customer is informed by e-mail of the availability of her order in store.

The withdrawal of the parcel can be made by the customer on presentation of a valid ID and his email confirming the availability of his order in-store. The parcel will be delivered against the signature of the client.

If for any reason the customer can not recover the order, a third person will be able to receive the package on presentation of the ID card of the customer who ordered and the confirmation email.

From the reception of the e-mail confirming the availability of the order in store, it is available in store during the next 15 working days. Beyond this period, the parcel will be put back in stock and the order refunded according to the means of payment used during the passage of the order except in case of purchase of gift card and loyalty card, this one is not refundable. An email confirming the refund will be sent.

EXPRESS DELIVERY IN STORE

The express delivery in store is free from 50 € of purchase, in the opposite case the amount of the expenses of port is 5 €. Attention to benefit from it the order will have to be carried out from Monday to working friday before midday. Any order placed after this time will be delivered within 48 hours and the shipping costs can not be changed.

The terms of receipt, tracking information and recovery of the order are subject to the same conditions as delivery in store.

COLISSIMO

A "Colissimo without signature" is distributed within 2 to 5 working days from the delivery to the carrier. 
The postman is not obliged to deliver to you personally because the parcel is a colissimo without signature, it has the possibility to:

  • deposit the package in the mailbox if it allows it.
  • To deliver the parcel to the guardian of the building taking his name.
  • To deposit a notice of passage in the mailbox inviting the customer to pick it up within 15 days with an ID at the post office. After this period the parcel is redirected to JEAN MARC PHILIPPE and the order will be refunded shipping costs deducted as of right.

The parcel is considered delivered (flashing of the parcel by the authentic factor):

  • either upon delivery of the parcel (deposited in the mailbox or delivered to the guardian) to the address mentioned by the client when ordering,
  • either from the provision of the package, indicated by the notice of passage of the factor inviting him to pick up the package at the post office.

SO COLISSIMO MY TRADER

Delivery in one of the 3,000 shops of our partner network, near your home, your place of work or holidays. You will be informed of the availability of your package by SMS and email, with a withdrawal voucher allowing you to come and withdraw it within 10 working days. After this time your parcel will be returned to sender.

B / For delivery in Austria, Belgium, England, Wales, Italy, Luxembourg, Netherlands, Germany, Spain and Portugal:

Colissimo Expert International

The colissimo expert is distributed within 5 to 10 working days after delivery to the carrier: (this delay does not include the preparation of the order which is 24 hours unless otherwise required). 
The postman is obliged to deliver the parcel in person to the addressee against signature. 
Delivery is deemed delivered when the signature has been affixed to the coupon of the postman.

10.4- DELAYS OF DELIVERY

The customer is invited to report the problem within 7 days of the alleged delivery date to JEAN MARC PHILIPPE in the Contact Us section. An identity document and a certificate on honor will be requested from the client. An inquiry will be opened at the carrier's complaint service and the client will be notified of the result by e-mail or mail.

For deliveries in Metropolitan France & Corsica: If the package is returned to JEAN MARC PHILIPPE by the Postal Service, JEAN MARC PHILIPPE will contact the customer within 7 working days from receipt of the package. After confirming the delivery address, JEAN MARC PHILIPPE will forward the package at his expense.

If the customer does not answer within 7 working days from the first email of the customer service, the package will be automatically refunded less transport costs which will be deducted by right.

Following the return of the parcel by JEAN MARC PHILIPPE at the customer's, if the parcel is returned a second time at JEAN MARC PHILIPPE, the customer will be able to request a second return for a refund. If the customer no longer wishes his parcel, the order will be canceled and the amount refunded minus the transport costs which will be deducted by right.

For deliveries in Germany, Belgium, Netherlands, Luxembourg, Great Britain, Italy, Spain: If the parcels are redirected to the JEAN MARC PHILIPPE headquarters, they will automatically be refunded shipping costs deducted by right.



ARTICLE 11: SATISFIED, EXCHANGED OR REFUNDED

For any return or exchange of articles, these must be in their original state, (products in new condition, unworn and unretouched, in their entirety - with all their accessories - and including their packaging) allowing thus JEAN MARC PHILIPPE to commercialize these products again.Attention cosmetics, gift cards and loyalty cards are neither exchangeable nor refundable.

In case of request for refund, it will be made according to the means of payment used during the order:

  • In the case of an initial payment in credit card or via Paypal: The refund will be made by crediting the bank account / Paypal within 14 days.
  • In the case of an initial payment in gift card (s): The refund will be done by creating one or more new gift card (s) deliverable immediately.

In case of return to the head office, only the refund will be feasible. The price of the purchased item (s) will be refunded, the shipping costs will be the sole responsibility of the customer. The refund of the order will be made in 14 days as from the date of reception of the parcel by JEAN MARC PHILIPPE.

11.3- RETURNS BY SO COLISSIMO MY TRADER

Only orders that have been delivered by SO COLISSIMO can be returned to the head office by the same means. To do this, the client will have to request a return label from the customer service and affix it to their package. The return will be free of charge for the client. His package will then be deposited in the relay point previously chosen.

For any return to the head office, only the refund will be feasible. The price of the purchased item (s) will be refunded, the shipping costs will be the sole responsibility of the customer.

In the context of a complete return of order due to a logistic error or defective products, the shipping costs paid during the order will also be refunded.

11.4- EXCHANGES AND RETURNS IN STORE JEAN MARC PHILIPPE

ARTICLE 16: APPLICABLE LAW - DISPUTES

These general conditions of sale are subject to French law. The language of this contract is French.
